Training and learning in the digital notarial era: educational and legal implications of electronic contracts in Ecuador

The digital transformation of the notarial function has redefined the way contracts are executed and formalized in Ecuador, driven by the need for legal modernization, administrative efficiency, and remote access to services. The implementation of electronic contracts as notarial acts allows for greater agility in processes and ensures the authenticity, integrity, and legal security of documents through the use of electronic signatures, digital platforms, and secure protocols. From a pedagogical perspective, this technological transition requires specialized training and education for notaries, lawyers, and system users, fostering digital competencies, understanding of electronic regulations, and best practices in handling digital tools. Additionally, it poses normative and technical challenges related to evidentiary validity, system interoperability, data protection, and continuous education of the stakeholders involved. This analysis highlights the importance of consolidating a robust regulatory framework that promotes citizen trust, ensures respect for due process, harmonizes notarial practice with constitutional principles and international standards on technology and law, and supports the development of pedagogical skills for competent professional practice in the digital era.
